Alec Baldwin’s motion to withdraw from Rust civil case dismissed by US judge

Alec Baldwin’s proposal to drop a civil lawsuit brought by the screenwriter for the movie Rust was rejected by a US judge.
amie Mitchell will be allowed to pursue her claims against the actor, who allegedly “recklessly” fired a prop gun that killed cinematographer Halyna Hutchins.
Her lawsuit alleges that Baldwin fired the weapon when it was not required in the Western script.
It names multiple defendants including Baldwin, David Halls, the assistant director who handed the gun to him, and Hannah Gutierrez Reed, the firearms man on the set.

Baldwin previously filed a motion to dismiss the lawsuit.
But on Tuesday, Judge Michael E Whitaker denied the offer as did another person who objected to the script supervisor’s request for punitive damages.
“The Court finds that Plaintiffs’ allegations in the SAC (second amendment complaint) represent alleged despicable conduct committed by the firing Defendants knowingly and knowingly disregard the rights or safety of others enough to withstand the proposed strike,” the ruling read.
“Accordingly, the Court rejected the motion to strike against Defendants Demurring.”
Gloria Allred, Ms. Mitchell’s representative, welcomed the judge’s decision not to remove Baldwin from the civil action.
She said: “We are delighted that we won and that the Court today allowed us, on objections of Alec Baldwin, to proceed with the case against him over assault theories, willful infliction of pain. our misery and negligence.
“In addition, the Court, over Mr. Baldwin’s objection, allowed us to proceed against him for damages.”

Ms. Hutchins was killed and director Joel Souza was injured in an incident on set in Santa Fe, New Mexico, just over a year ago on October 21.
It came as the Santa Fe district attorney received the final report from the Sheriff’s Office on the incident.
A department spokesman said district attorney Mary Carmack-Altwies will now begin reviewing the information to make a “timely, thoughtful decision” on whether to bring charges in the case.
In a statement shared with the PA news agency, a spokesman said the DA remained focused on the “pursuit of justice” in the case.
Last month, an undisclosed settlement between Baldwin and the cinematographer’s estate was made, although the DA’s office previously said it would have “no impact” on the ongoing criminal investigation. out.
