Anne Heche’s son says ‘will’ presented by ex-partner James Tupper is invalid

Anne Heche’s son claimed that the “will” presented by her ex-partner was invalid because it was not signed in the late actress’s handwriting.

omer Laffoon, 20, filed a claim for control of his mother’s estate earlier this month, following her death, which was met with objections from James Tupper.

The young man’s petition was made on the grounds that the actress had died without leaving a will.

Court documents obtained by the PA news agency show that although Tupper has yet to disclose his specific objections to Laffoon’s legal team, he did present an email he called “” testament”.

The 20-year-old’s attorneys say the email in question “does not meet the legal requirements” for a valid three-way will.

“Mr Tupper repeatedly referred to the email attached to the Objection as a ‘will’,” the documents, filed as a supplement to the state, Laffoon’s original petition.

“However, legally, email does not qualify as a three-way will or officially witnessed will.

“The email does not meet the legal requirements for a valid three-way will because key provisions of the purported will are not present in Decedent’s handwriting.

“The email does not meet the legal requirements for a valid will to be formally witnessed because the email was not signed by Decedent and there were not two witnesses who signed the document during Decedent’s lifetime. “

The filing also claims that Tupper made “personal attacks” on Laffoon ahead of an October 11 hearing to further determine the management of Heche’s estate.
