A 10-year-old boy is being held in a US jail accused of texting a friend claiming he bought assault rifles.

Daniel Marquez, from Florida, was held by a judge for 21 days and accused of making a written threat after his friend’s father allegedly discovered a series of troubling texts and contacted the police.

Authorities claim Daniel sent a text that read “I bought this” followed by a picture of four assault rifles before sending another text that read “Get ready for water day”.

It is understood that the text referred to the Water Day celebrations held at the child’s school at the end of the school year.

The messages came four days after a school shooting in Texas killed 19 children and two teachers.

Authorities allege Daniel implied in his messages that he would initiate a gun incident at Patriot Elementary School in Cape Coral.

However, his attorney Douglas Molloy said the messages were an attempt at humor and had been misunderstood.

They told acc DailyMail.com : “Based on a review of what was provided to me, Daniel texted a friend and they went back and forth, a torrent of texts on a variety of subjects.

“And in it was what I can only call an attempt at humor – but fifth grade humor.

“He made an unfortunate reference to assault rifles, but only in a joking manner, unrelated to any sort of attack on a school.”

Molloy is fighting for the boy’s release and said his client “didn’t directly say he was going to shoot a school”.

But in a radio interview, Lee County Sheriff Carmine Marceno said, “If a 10-year-old pulls a trigger, the consequences are the same regardless of age.”

He said the “false threat” could have “real consequences”.

As a result, Daniel was handcuffed at his home and placed in the back seat of a police car, DailyMail.com reports.






Daniel Marquez is a fifth grader from Florida

He is now understood to be being held at Collier County Juvenile Prison in Naples, about 55 miles from his home.

US President Joe Biden has urged Americans to put pressure on congressmen to pass sensible gun laws after the school shooting in Texas.

“As a nation, we have to ask ourselves when in God’s name are we going to stand up to the gun lobby, when in God’s name are we going to do what we all know in our guts needs to be done,” Biden said.

“I’m sick and tired. We have to take action. And don’t tell me we can’t control this bloodbath.”

The United States experienced 61 “active shooter” incidents last year, a sharp increase from the previous year and the highest number in over 20 years, the FBI reported this week.
