He was acquitted of aggravated burglary spying on Annabel Everitt as she walked home from a night out on November 21, before banging on the door and entering the house with a knife.
The jury was given a recording of Dr. Towler’s call to 999 on October 30. He told the operator he needed police and an ambulance after being attacked with a knife.
The operator told him to keep talking, and asked him where he was injured. Towler replied: “Bleeding in the head and abdomen.
“It’s a bit difficult to be coherent. Now I sit down. I have pain in my chest and abdomen.”
The operator repeatedly reassured Dr. Towler that help was being worked on. Dr. Towler told him that he found it difficult to breathe deeply and that he did not want to look at his wound.
He tried to describe his attacker, saying he was wearing a gray hoodie. He estimated that the attacker was holding a knife and appeared to be between 30 and 50 years old, and about 5ft 8ins to ft 10ins tall.
Dr. Towler said: “He knocked on the door, attacked me with a knife and chased me down the street. He stabbed me with a knife maybe twice.
“I do not know him.” Immediately after the police and paramedics arrived at the scene, the court held a hearing.
The court said the alleged attack against Mr Rozmiarek happened as he sat on a bench at the intersection of Apsley Road and Whiteladies Road.
Witness Thomas Wainwright said he was at Caledonia Place, Clifton, when a black man in his 20s and 25s jogged with him, wearing a hooded jacket.
Mr. Wainwright said: “I didn’t see him bring anything or throw anything away. There was nothing to make me suspect a crime was going on.”
Mr Rozmiarek testified in court that he was slashed in the head after receiving two or three blows from behind while sitting on a bench at the junction of Apsley Road and Whiteladies Road. “Those hits that, within a second, like an explosion from a sub-machine gun, are really quick,” he said.
The court heard a Bristol University security guard, who tried to no avail, took Mr Rozmiarek to Southmead hospital – but Mr Rozmiarek was told to wait 5 hours for treatment so he walked home and self-treated the wound.
Edward Hetherington, a defender of Maximen, said his client’s mind “works differently” than others. He said Maximen, who has no criminal record, was “polite, calm and respectful” but was tough to deal with incarceration.
Dr Towler read a statement about the impact of the attack saying that the attack made him feel scared when walking on the street or people coming to his doorstep. However, he said he tried to imagine how Maximen endured his limited freedom in prison.
The doctor said: “I was lucky – and I am alive – but I am very close to death. I will say it again, I am not mad at you – but I want to tell you that I am a real human being – just like you – and I respect our lives equally. We’re all human, living, loving, hating.
“But murder shouldn’t be a human thing – and it almost happened, and I’m not sure if you want that to happen when you stab me. If I were in your position – it would be. It’s a very scary thought for me, but I don’t know if you understand it or what it’s like for you.”
Outside the court, the doctor confirmed that, one day, he would like to sit down with Maximen and talk. He told Bristol Live: “I remember very well sitting in the house with poor breathing. It’s one of those things that you think – am I looking at my own death here? But I was lucky and I survived.”
