Dublin man who put his arms around his partner’s neck and said he would kill her avoids jail

A man who punched and kicked his ex-partner in a “savage” attack before standing on her neck and telling her he was going to kill her has been sentenced to a full suspended jail sentence.

ndrew Brennan, 41, left the woman with significant bruising, two black eyes and damaged teeth after the attack, which came after a 24-hour drunk and drug spree, the Dublin Circuit Criminal Court heard.

Brennan, with an address in Castlecurragh Vale, Mulhuddart, Dublin, pleaded guilty to causing physical harm and threatening to kill a woman at an address in Tyrellstown, Dublin on May 6, 2021. He has no criminal record.

Judge Martin Nolan sentenced him on Wednesday, saying it was a “wild assault” and that Brennan’s actions were disgraceful. He said he could accept that Brennan was unlikely to reoffend on this scale in the future.

“They drank together and took illegal drugs. Assaulting a woman is a serious matter, but I have to consider the background to the case,” he said, before concluding that “it would be unfair to imprison him.”

He ordered Brennan to collect a sum of €2,500 to be passed on to the victim or to a charity. He said that compensation should help the injured party a little and punish the offender.

Garda Adam Kernan told Emmet Nolan BL, prosecutors, that Brennan and his former partner had previously met and socialized on occasion. On the night in question, the couple had been drinking and using cocaine for a 24-hour period.

They were in a car in Tyrellstown when they started arguing, the court heard. Brennan then punched and punched the woman in the face before pulling her out of the car by her hair. He repeatedly kicked her as she lay on the ground and then stood on her neck for about a minute.

During that time, the woman struggled to breathe, and Brennan told her, “I’m going to fucking kill you,” the court heard. Then he got back in the car and drove off, leaving her on the ground.

The court heard the woman incurred €600 in medical expenses after the attack. She suffers from nightmares and flashbacks.

Jennifer Jackson BL, who is defending herself, told the court the couple had a toxic relationship in which they met over alcohol and drug excesses. She said it was a “unique situation” in which they both drank alcohol and used cocaine about 24 hours before the attack.

Brennan’s memories of the events of that night were “vague,” the court said.
