Grandfather (42) imprisoned for gun offenses, caught with cell phone in prison

A GRANDFATHER jailed for possessing a semi-automatic pistol has been sentenced to an additional two months after he was caught using a mobile phone in jail.

Enneth Fitzsimons, 42, is serving his sentence when officers found the phone at Wheatfield Prison, a court heard.

His young son’s mother died while he was in custody and he was not allowed out for the funeral, his defense said.

Judge Gerard Jones imposed the two-month sentence, but implemented it at the same time as his existing prison sentence.

Fitzsimons, father of three of Corduff Place, Blanchardstown, pleaded guilty. The court heard prison guards found the phone on April 20 this year.

Fitzsimons served five and a half years with a release date of 2023. He had no prior convictions for phone possession in prison.

The defendant had a son who was born while he was in custody, defense attorney Simon Fleming said.

That child’s mother had died while Fitzsimons was inside and he was unable to go to that funeral, he said.

Fitzsimons accepted he had made some “bad decisions”, Mr Fleming said. He had already been disciplined in prison and the lawyer asked the judge not to extend the defendant’s sentence.

Fitzsimons was arrested in Dublin Circuit Criminal Court in 2019 for possession of a loaded pistol, dangerous driving and resisting arrest.

His then 19-year-old son, Dean Fitzsimons, was sentenced to seven years in prison for a series of offenses including possession of firearms.
