Johnny Depp has denied “fainting” in a photo showing ice cream running down his legs, telling a courtroom he was asleep and his ex-wife Amber Heard gave him the ice cream

Johnny Depp: Expert Discusses Trials This Morning

A candid photo of Johnny Depp “passing out” with ice cream on his lap has been shown in a courtroom with his ex-wife Amber Heard as part of the actor’s ongoing defamation trial.

The Pirates of the Caribbean actor, 58, has accused his ex-wife, 36, of staging the embarrassing photo after he returned from a long day of filming in Boston.

The court was also shown a snapshot of what appeared to be cocaine, alcohol and tobacco on a table, taken at a time when Depp admitted he had “fallen off the wagon”.

The ‘Edward Scissorhands’ star is suing the ‘Aquaman’ actress for defamation over a 2018 article she wrote in the Washington Post. His lawyers say he physically and sexually abused her, damaging his career and reputation.

The trial began last week with Johnny taking the witness stand over the past few days with a number of allegations that have already been made.

Yesterday, on the last day of this week’s hearing, the court was shown a picture of Depp seated on a sofa, wearing a plaid shirt and jeans, with his head thrown back and his eyes closed.

An empty sundae is on his lap, the food has been spilled onto his pants. The photo was taken while Depp was in Boston filming the film Black Mass in 2014.

Amber’s attorney, Ben Rottenborn, told Depp, “That’s a picture of you on a black leather couch, right?”

Depp replied: “Unconscious is an interesting way of putting it, maybe asleep.”

He explained: “Miss Heard asked me to hold the ice cream when she realized I was on the nap, meaning I was recovering from the 17 hour day I was working and also from the opioids that I was taking I had injected fell asleep.

“You’ll notice my right hand is in my pocket, so I didn’t attend the Ice Cream Festival.

“I held her ice cream and because she knew what was going to happen I fell asleep. That was a wonderful photo for her. I don’t know why she did it.”

Mr Rottenborn then asked Johnny if it was her fault the picture had been taken.

“She tore it,” Johnny replied.

Another photo, taken in 2013, was presented to the court, which appeared to show alcohol, four lines of cocaine, tobacco, a newspaper and a CD on a table.

Johnny admitted under cross-examination that the photo was taken at a time when he had “fallen off the car”.

When asked if he often drinks whiskey in the mornings, Depp replied, “Isn’t it always happy hour?” Laughter from the gallery.

Depp has sought damages of “no less than $50 million” as he claims the comment hurt his career.

In August 2020, in response to his defamation lawsuit, Amber filed a counterclaim, seeking “not more than $100 million” in damages.

The trial in Fairfax County Court is scheduled to last seven weeks.
