Johnny Depp says he suspected Amber Heard was having an affair with James Franco

Johnny Depp told the court during his trial of his ex-wife Amber Heard he feared she was having an affair with James Franco.

r Depp was questioned by Ms Heard’s legal team on Thursday in Fairfax, Virginia, as part of his defamation trial against her. The actor sued his ex-wife in 2019, claiming she defamed him in a December 2018 comment published in The Washington Post entitled “I spoke out against sexual violence – and faced the wrath of our culture. That needs to change.”

Mr Depp was asked by opposing attorney Ben Rottenborn if he had had a heated argument with Ms Heard, who was making a film with Mr Franco, about whether she was having an affair with her co-star.

Mr Rottenborn quoted Mr Depp from an earlier statement in which he said: “I don’t remember but it’s very likely”.

Mr Depp confirmed he suspected Ms Heard and Mr Franco were having an affair. Asked if Ms Heard condemned his alcohol and drug use, Mr Depp said: “It has been a constant”.

The dispute allegedly took place the day before a private flight on May 24, 2014, when Mr Depp and Ms Heard flew from Boston to Los Angeles.

Audio of Mr Depp moaning in pain after mixing opioids and alcohol was played in court as the actor was questioned by Ms Heard’s legal team.

Mr Rottenborn read an email from Mr Depp to Ms Heard which was sent the following day. “I once again find myself in a place of shame and regret,” Mr Rottenborn said, citing the email.

“Of course I’m sorry, I really don’t know why or what happened, but I will never do it again,” he added. “I want to get better for you and for me – I have to. My illness somehow crept in and got hold of me. I can’t do it again, I can’t live like this again, and I know you can’t either.”

Mr Rottenborn said Mr Depp texted his “good friend”, British actor Paul Bettany, five days later that he had been drinking all night before flying to LA, that he had not had anything to eat for days, that he Pulver consumed – referring to cocaine – half a bottle of whiskey, “a thousand” Red Bull and vodkas, pills and two bottles of “champagne” on the plane.

“What do you get? A raging aggro engine in a freaking blackout,” Mr Rottenborn said, quoting Mr Depp’s message to Mr Bettany. “Shouting profanities and insulting every turd that came near.”

“I’m done, I’m admittedly too crazy in the head to vent my anger at the one I love,” Mr Depp added, according to court documents.

Mr. Rotterborn asked if the two bottles of champagne on the plane related to the flight between Boston and LA.

“Yes, it comes just after a thousand cans of Red Bull,” Mr Depp replied.

Mr Rottenborn went back to Britain’s transcript, which asked Mr Depp if he had been drinking or using drugs before or during the flight, to which Mr Depp said: ‘Sure, to get through this we say yes – everything you said – I agree”.

Mr Depp said he “relented” to questioning at the time.

The Heard legal team then played three excerpts from an audio piece of Mr Depp, who appeared to be moaning in pain.

“It sounds like a tortured animal and it’s my voice,” Mr Depp said in response to the audio recording.

In the final excerpt, Mr Depp’s former security guard, Jerry Judge, can be heard saying: ‘I’ll stay with that bloody idiot in case he gets sick’.

“The recording of the painful sounds is not from that flight,” Mr Depp said, without specifying where or when the recording was made.

In her 2018 comment, Ms Heard wrote: “Like many women, I was molested and sexually assaulted when I was college-age. But I was silent – I didn’t expect that filing complaints would bring justice. And I didn’t see myself as a victim.”

“Then two years ago, I became a public figure representing domestic violence, and I felt the full brunt of our culture’s anger at women speaking out,” she added at the time.

While Mr Depp is not named in the piece, his legal team argues that it contains a “clear implication that Mr Depp is a domestic abuser”, which they say is “categorically and demonstrably false”. Mr Depp is seeking “not less than $50 million” in damages.

Ms Heard has filed a $100 million counterclaim against Mr Depp for harassment and immunity from his allegations.
