A father-of-six who obstructed a drug hunt by swallowing alleged “deals” claimed a Garda mistook his teeth for crack cocaine.
Oseph Moore, 57, also told the officer he would “take him off duty” and kill him if he resisted vigorously when arrested.
Moore, of Highfield Estate, Newbridge, Co Kildare, denied obstructing a search and threatening to be abusive and abusive.
Judge Paula Murphy found him guilty, saying Moore’s account was implausible, and sentenced him to a month’s probation.
Dublin District Court heard a Garda see the accused in an alleged drug transaction where he took an object from his mouth and handed it to a man at Wood Quay on September 21 last year.
The Garda told Moore to open his mouth and saw what he believed to be two deals of crack cocaine.
When asked to spit them out, Moore swallowed them and pushed the Garda away before saying “F**k you” and refusing to reveal his identity.
He was arrested after a violent struggle in which he fiercely resisted.
Moore gritted his teeth and yelled threats “right in my face,” the Garda said.
“I’ll get you off duty, I’ll kill you if these handcuffs come off, you’re a scumbag,” the accused had told the public.
Moore claimed he was leaving an appointment at the Dublin City Council office when the Garda approached him, jumped off a bike and said, “Hey you, come over here.” He said the Garda asked what was in his mouth , and he replied: “I have nothing but my dentures.”
He denied using profanity and said the Garda immediately handcuffed him. The Garda said a common “MO” for drug dealers is to “deal by mouth”.
“Dentures do not resemble crack cocaine,” the Garda said.
Moore had been on methadone for 20 years, his attorney told the court.
