According to one legal expert, Roman Abramovich’s decision to hand over “care” of Chelsea to their charity simply gives them “caretaker” ownership of the Blues.

Russian billionaire make a shocking statement when he withdrew from the west London club he had owned since 2003.

His nationality and ties to the top lights in his hometown have seen Abramovich come into the spotlight as Russia wages an invasion on Ukraine.

The 55-year-old billionaire’s decision to hand over control still leaves many unanswered questions amid a congressman’s call for the billionaire’s assets to be seized.

But one legal expert believes there could be a big split if Chelsea’s interests conflict with Abramovich, who remains their owner.

Stephen Taylor Heath, Head of Sports Law at JMW Solicitors“Journalists, advocates and experts have been analyzing Chelsea yesterday’s statement tries to understand what it really means.

“If the government is considering sanctions against Abramovich, it will seek legal advice on what it really means to determine if it is in fact just a PR operation.

“In a legal context, management does not mean the job of overseeing or taking care of something, or in other words the job of a ‘caretaker’. If you put someone to ‘manage’ your house because you are abroad, you will be somewhat annoyed if, when you return, the custodian tries to claim ownership of your home.

“In the pilot application of owners and directors (OADT), the Football Association and Premier League always worry about determining who has actual control of a football club when presented with a separate legal entity as the proposed owner.

“The most recent example of this involves a takeover Newcastle United as the Premier League seeks to establish whether the Saudi Arabia Public Investment Fund (PIF) is under actual control.

“If the government decides that Abramovich should not take control of the club, the Premier League will immediately have to analyze whether ownership of the club has in fact transferred to the Trust.

“A shareholder or related party can appoint a nominee to the board of a company to take care of their interests. It is likely that Abramovich is in fact saying that the Trust serves as his de facto nominee on the board.

The decision of the Russians leaves Chelsea with many unknowns

“In this regard, at this stage, the Trust will carefully consider whether it should accept the concept of acting as club manager in place of Abramovich on the basis of the fact that it could damage his position. theirs or not.

“In the statement, Abramovich said that he believes the Trust has the same club’s best interests as he does.

“The veracity of that statement will be deeply noticed if a situation arises in which the interests of the club could conflict with those of Abramovich. What if Abramovich sought to invoke the terms for the club? What if the club wants to take steps to cut off legal ownership?

“Clearly the club and the Trust itself will need to elaborate on Mr Abramovich’s statement to clarify the legal situation.”

Following Saturday’s announcement, Chelsea released a statement on Sunday morning regarding the current situation in Ukraine – but without mentioning Russia and its invasion of the county, which is a call for peace.

It simply says: “The situation in Ukraine is terrible and devastating. Chelsea FC’s thoughts are with everyone in Ukraine. Everyone at the club is praying for peace.”
