An engineer was fired after he had an affair with his boss’s wife – before he tried to sue for unfair dismissal by claiming they had only ever had outside sex.
Anthony Smith was fired after it emerged that he had a secret relationship with Lyndsay George for eight months.
Ms. George – co-director of a drainage company with her husband Rob – confessed that she and Mr. Smith engaged in messy behavior in the office during working hours.
The 38-year-old also admitted that she and Mr Smith had been intimate in some corporate vehicle.
Mr. Smith, who has worked for the company for 11 years, is also accused of sending nude images that Ms. George said she sent him herself to colleagues.
After the case became public, the engineer was fired by Yorkshire’s Full Circle Irrigation – which works on golf courses and sports fields – for serious misconduct.
He tried to sue the company for unfair dismissal saying they had only ever had sex outdoors – even though much of the affair took place over the winter.
However, after a trial, he lost his case to Full Circle, which works with Premier League side Leeds United and some of the UK’s top golf courses.
Mrs George, who lives with her husband in a £350,000 home in Knaresborough, near Harrogate, North Yorks, has resigned as director after admitting an affair with Mr Smith.
However, she is currently working back at the company as an administrator.
Employment Court in Leeds, West Yorkshire, heard that Mr Smith and Mrs George embarked on a relationship in the spring of 2020.
The hearing was told in January 2021 that a suspicious colleague had raised concerns that they were having an affair, which Ms. George had admitted to her husband.
A court report said: “There is no question that Mr. Smith had an extramarital affair with Mrs. George, who was a director of the company and was married to Mr. George at the time. from spring 2020 to January 2021.
“On January 22, 2021, Ms. George admitted to Mr. George that she had a sexual relationship with Mr. Smith.
“Mr Smith was suspended on the same day.
“Miss George said she had sex with Mr. Smith at the office and in the car during work hours.”
As part of the disciplinary process, Mr Smith also faces abuse charges after he shouted and cursed Mr Smith at Leeds United’s training ground four months earlier and alleged xenophobia against commenters. Commentary for Polish and Romanian colleagues.
The investigation – which also examined an allegation that the engineer had shared nude photos of Ms George with staff – was carried out by an outside staffing firm, citing “touching” matters. like, the hearing was told.
In his defense, Mr Smith insisted he did not have sex with Ms George at the time of the company or property as alleged and said the allegations of abuse were “fabricated”.
Mr Smith claimed Mr George had a desire to “get rid of him” and complained he felt like he was “accused of murder”.
However, he was fired for misconduct on the advice of his HR company in February 2021.
Mr Smith claimed instead of having sex outdoors and that the witnesses against him were “bribed”, but Employment Judge Emma Tegerdine dismissed the plea and made an unfair dismissal.
Judge Tegerdine said: “The court found Ms. George to be a reliable witness. Ms. George answered directly and candidly to the questions she was asked, and there was no reason for her to be dishonest about it. what happened between you and Mr. Smith.
“However, the court found Mr. Smith’s evidence to be inadequate.
“The court found his assertion that his affair with Miss George, which took place over a period of at least eight months, some in the middle of winter, made entirely outside, was undeniable. argue.
“The court found his suggestion that a number of witnesses gave evidence in the process [the HR] the investigation has lied or has been bribed when there is absolutely no evidence to support this, which is too far away.
“(He) is fully responsible for being fired. (His) behavior is reprehensible and reprehensible.”
However, the court did not uphold the allegation that Mr. Smith shared nude photos of Mrs. George that she had sent him.
“Although the Court accepted Ms. George’s evidence that she had shared nude images of herself with (Mr. Smith), there is no clear evidence that (he) had never shared them with anyone. anyone,” the ruling said.
The court heard Ms. George resign in February 2021 – but soon rejoined the company as an administrator.
The hearing said she avoided disciplinary proceedings on her own by resigning.
Full Circle Irrigation, based in Knaresborough, near Harrogate, says it is “primarily active in the sports lawn irrigation market”.
The company works on golf courses across the UK – including the historic Prestwick Golf Club in Scotland, which was the original venue for the Open Championship.
