The ban on Facebook data transfers between the EU and the US is approaching

Ireland’s Data Protection Commissioner is pushing ahead with a ban on Facebook and Instagram data transfers from the EU to the US.

Elen Dixon’s office is now forwarding its decision to other European data regulators, who have one month to comment or raise objections.

The move could mean a disruption to the world’s largest social media platform, whose revenue depends mostly on online advertising.

Meta, the parent company of Facebook and Instagram, has previously said it may not be able to operate services in the EU with such a ban.

The decision does not directly affect Whatsapp or other companies outside of Meta.

The potential ban comes as the EU and US are in negotiations over a legal mechanism for data transfers between the two zones.

In 2020, the European Court of Justice ruled that a previous transfer agreement dubbed the “Privacy Shield” was insufficient to protect the privacy rights of EU citizens in the US. The court found that unjustified surveillance in the US remains an unacceptable obstacle and that the Irish Data Protection Commissioner has a duty to enforce the rights of European citizens.

Meta has not yet commented on the Irish DPC’s referral to other regulators.

However, the company’s President of Global Affairs, Nick Clegg, recently described a future ban on EU-US data transfers as damaging to thousands of European companies and disruptive to healthcare and education institutions that rely on online platforms for their daily work .
