The Dublin mum spared jail after kicking a police officer in the stomach as the officer and her colleagues tried to break up a brawl

A Dublin mother who kicked a Garda in the stomach when the officer and her colleagues tried to break up a street brawl was spared jail.

Hloe McDonagh, 24, of Gateway Mews, Ballymun, has been convicted and fined €400 after pleading guilty earlier on Wednesday.

She was charged with attacking the Garda on Dorset Street and disobeying an order to leave the area in the early hours of 24 July.

Dublin District Court heard the incident began after she had an argument with her husband and others became involved.

Court moderator Garda Sergeant Laura Byrne told Judge John Brennan that Gardai intervened and attempted to arrest one of the group.

McDonagh attempted to pull an officer away by restraining her stab vest and then kicked a female Garda in the stomach.

The mother of one had no criminal record.

Judge Brennan found that the Garda did not require medical attention, but described McDonagh’s actions as “completely unacceptable.”

He said she intervened as Gardai went about their work in an “elevated situation”.

He also noted that she had not apologized to the officer.

The defense contended that McDonagh had hoped to apologize in court; However, the Garda did not have to attend the hearing.

He described the incident as “by no means a minor attack” and added that he took a very “somber” view of their involvement in a situation that was “difficult enough for Gardai”.

Her husband Martin A. McDonnell, 23, also of Gateway Mews, Ballymun, was spared a conviction and received the criminal probation law after pleading guilty to a public order charge.

The couple received welfare.

He had no criminal record. Judge Brennan said he hoped the defendant learned a lesson.

The court heard him “take his shirt off and clench his fists” as the argument spilled onto the street.

His father, Martin McDonnell Snr, 42, of Heathfield View, Cappagh Road, Finglas, Dublin, has been fined €100 after admitting he had not left the area during the argument.

He told Gardai he would fight them until they warned him they were using pepper spray.

The court heard the father of three, who also looks after another family member, had 21 convictions for traffic offenses.
